1. Aceitação

Estes Termos de Uso ("Termos") regem o uso do Booklog, o aplicativo e a versão web em getbooklog.com (juntos, o "App"), publicado pela Demerzel Studio LLC ("Demerzel Studio", "nós"). Ao instalar, abrir ou usar o App, você concorda com estes Termos. Se não concordar, não use o App.

2. Licença de uso

Concedemos a você uma licença pessoal, não exclusiva, intransferível e revogável para instalar e usar o App em aparelhos que você possui ou controla, e para acessar a versão web pelo navegador, para uso pessoal e não comercial, dentro das regras da App Store ou do Google Play.

3. Conta

Você pode usar o App sem conta. Se entrar com Apple ou Google, seus livros, registros e citações ficam salvos e sincronizados entre aparelhos. Você é responsável pelo acesso à sua conta Apple ou Google.

4. Assinatura Pro

Planos: mensal (R$ 10,00 por mês), anual (R$ 80,00 por ano, com 3 dias grátis) e vitalício (R$ 300,00, pagamento único). Valem os preços mostrados no momento da compra, na loja ou no site.
Você assina pelo app, na App Store ou no Google Play, ou pelo site em getbooklog.com. A assinatura feita pelo site é cobrada pela Stripe. O Pro vale na mesma conta, no app e na web, qualquer que seja o lugar da compra.
A versão web em getbooklog.com faz parte do Pro: você entra lendo um código QR com o app.
Mensal e anual renovam automaticamente até você cancelar.
Assinatura feita pelo site: o cancelamento é feito no portal do assinante (link no e-mail do recibo) ou em Você, no app.
Assinatura feita na loja: o cancelamento é feito nos ajustes da App Store ou do Google Play; não conseguimos cancelar por você.
Reembolsos da assinatura feita pelo site são da Demerzel Studio: peça a support@demerzelstudio.com em até 7 dias da cobrança (direito de arrependimento do Código de Defesa do Consumidor). Compras feitas na loja seguem a política de reembolso da Apple ou do Google.

5. Seu conteúdo

Citações, notas e comentários que você cria continuam seus. Para guardar e sincronizar esse conteúdo, você nos dá permissão de armazená-lo e mostrá-lo apenas a quem você escolher (você mesmo, amigos aceitos, membros de um clube ou todos, na sua página pública em getbooklog.com). Você é responsável pelo que publica.

6. Amigos, desafios e clubes

Seu progresso só aparece para amigos que você aceitou, a não ser que você deixe uma parte do perfil visível para todos. Em clubes e leituras conjuntas, respeite os outros leitores: nada de assédio, discurso de ódio, spam ou spoilers fora das áreas travadas por página. Podemos remover conteúdo ou suspender contas que violem estas regras.

7. Uso aceitável

Você concorda em não: (a) usar o App para fins ilegais; (b) tentar fazer engenharia reversa do App, salvo quando a lei permitir; (c) interferir no funcionamento do App ou de seus servidores; (d) publicar conteúdo que viole direitos de terceiros, incluindo reproduzir livros inteiros.

8. Isenção de garantias

O App é fornecido "no estado em que se encontra", sem garantias de qualquer tipo. Dados de livros e capas vêm de fontes como Google Books, Open Library e Hardcover e podem ter erros.

9. Limitação de responsabilidade

Na máxima extensão permitida em lei, a Demerzel Studio não responde por danos indiretos, incidentais ou consequentes, nem por perda de dados decorrente do uso do App. Nossa responsabilidade total fica limitada ao valor que você nos pagou pelo App nos 12 meses anteriores à reclamação.

10. Lei aplicável

Estes Termos são regidos pelas leis dos Estados Unidos, sem prejuízo dos direitos garantidos pelo Código de Defesa do Consumidor a usuários no Brasil.

12. Mudanças

Podemos atualizar estes Termos. A data de vigência no topo muda junto, e o uso contínuo do App depois disso vale como aceite.

1. Acceptance

These Terms of Service ("Terms") govern your use of Booklog, the app and the web version at getbooklog.com (together, the "App"), published by Demerzel Studio LLC ("Demerzel Studio", "we", "us"). By installing, opening, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, and to access the web version in a browser, for personal, non-commercial use, subject to the App Store or Google Play usage rules.

3. Account

You can use the App without an account. If you sign in with Apple or Google, your books, reading logs, and quotes are saved and synced across devices. You are responsible for access to your Apple or Google account.

4. Pro subscription

Plans: monthly (R$ 10,00 per month), yearly (R$ 80,00 per year, with a 3-day free trial), and lifetime (R$ 300,00, one-time payment). Prices shown at checkout, in the store or on the website, apply.
You subscribe in the app, through the App Store or Google Play, or on the website at getbooklog.com. Subscriptions bought on the website are billed by Stripe. Pro works on the same account, in the app and on the web, wherever you bought it.
The web version at getbooklog.com is part of Pro: you sign in by scanning a QR code with the app.
Monthly and yearly plans renew automatically until cancelled.
Website subscriptions: you cancel in the subscriber portal (link in your receipt email) or under You in the app.
Store subscriptions: you cancel in your App Store or Google Play settings; we cannot cancel on your behalf.
Refunds for website subscriptions are handled by Demerzel Studio: ask at support@demerzelstudio.com within 7 days of the charge (right of withdrawal under the Brazilian Consumer Protection Code). Store purchases follow Apple's or Google's refund policies.

5. Your content

Quotes, notes, and comments you create remain yours. To store and sync them, you allow us to host them and show them only to the audience you choose (yourself, accepted friends, members of a club, or everyone, on your public page at getbooklog.com). You are responsible for what you post.

6. Friends, challenges, and clubs

Your progress is visible only to friends you accept, unless you make a part of your profile visible to everyone. In clubs and buddy reads, respect other readers: no harassment, hate speech, spam, or spoilers outside page-locked areas. We may remove content or suspend accounts that break these rules.

7. Acceptable use

You agree not to: (a) use the App for unlawful purposes; (b) reverse-engineer the App except as permitted by law; (c) interfere with the App or its servers; (d) post content that infringes the rights of others, including reproducing entire books.

8. Disclaimer

The App is provided "as is", without warranties of any kind. Book data and covers come from sources such as Google Books, Open Library, and Hardcover and may contain errors.

9. Limitation of liability

To the maximum extent permitted by law, Demerzel Studio is not liable for indirect, incidental, or consequential damages, or for loss of data arising from your use of the App. Our total liability is limited to the amount you paid us for the App in the 12 months before the claim.

10. Governing law

These Terms are governed by the laws of the United States, without prejudice to the rights granted to users in Brazil by the Brazilian Consumer Protection Code.
